Trademark assignment in Belarus requires recordal with the Belarus PTO. This FAQ covers the required original documents, assignment deed requirements, fees and possible obstacles.

Which documents are required for trademark assignment in Belarus?
The usual set includes:
- original trademark registration certificate
- original PoA in the name of the assignor and/or assignee
- assignment deed signed by both parties in two identical originals
What are the requirements for the assignment deed?
The assignment deed should be signed by the heads of the assignor and assignee companies in two original identical copies. If another person signs, authority to sign should be confirmed; otherwise notarization with confirmation of authority may be required.
Should the assignment deed mention consideration?
Yes. Under Belarusian civil law, the deed should specify a particular amount of compensation, for example 1 EUR.
What is the cost of assigning one trademark registration?
The cost is about 435 EUR.
What is the cost of each additional trademark in one assignment request?
The cost for each further trademark registration in one assignment request is about 160 EUR.
Are translations required?
Documents in a foreign language should be translated into Russian for filing with the Belarus PTO. Short documents of up to 2 pages may be translated from English into Russian free of charge; longer translations are charged separately.
How long does assignment recordal take?
The time period for recording an assignment is about 1 month.
Is an e-signed assignment deed acceptable?
No. An e-signed assignment deed is not acceptable in Belarus.
Is a notarized copy of the assignment deed acceptable?
No. Two original identical copies of the assignment deed are required.
Can similar marks owned by the assignor be an obstacle?
Yes. Identical or confusingly similar registrations in the name of the assignor may be an obstacle if they cover the same classes and the same or similar goods or services.
