Assignment of IP Rights in Belarus

In Belarus, intellectual property rights may be transferred from one party to another through an assignment agreement. Assignment is possible for both registered rights and pending applications.

The assignment must be recorded in the State Register in order to be legally effective against third parties.

General Procedure

Assignment applies to inventions, utility models, industrial designs and trademarks. The procedure is broadly similar across all objects.

Timeframe

Approximately one month for recordal.

Key Requirement

A notarized copy of the assignment deed is not accepted — original signed documents are required.

Required Documents

  • Original or copy of Power of Attorney (depending on case)
  • Assignment Agreement signed by both parties
  • Original certificate (for registered rights)

Important: The assignment deed must be signed by authorised company representatives (Director/CEO/President).

Costs

Assignment of one right: approximately 435 EUR.

Each additional right in the same agreement: approximately 160 EUR.

For pending applications, the cost is lower (starting from approx. 260 EUR).
