Integrated circuit topographies may be protected in Belarus as a specialised industrial property object relating to the layout-design of an integrated circuit.
This form of protection concerns the spatial arrangement of elements of an integrated circuit and the connections between them, fixed in a material form.
Protection of an integrated circuit topography should be distinguished from patent protection for technical solutions, copyright protection for documentation or software, and trade secret protection for confidential know-how.
In Belarus, legal protection of an integrated circuit topography is based on registration with the National Center of Intellectual Property.
Protection is directed at the original topography itself. It does not extend to ideas, methods, systems, technologies or information as such, even where they may be embodied in the integrated circuit.
For this reason, topography protection is usually considered as one element of a broader protection strategy for microelectronics, semiconductor products or related technical documentation.
An application for registration is filed with the National Center of Intellectual Property.
The filing materials generally include a request for registration, deposited materials identifying the topography, an abstract, proof of payment of the official fee and a power of attorney where the application is filed through a representative.
Deposited materials may include layout drawings, layer-by-layer materials, photographs of layers or photomasks, or other materials sufficient to identify the topography.
Integrated circuit topography protection is a narrow and technical form of IP protection. It may be relevant where the layout-design itself has independent value and needs to be documented and protected as a registered object.
Where the project also involves technical inventions, software, confidential manufacturing information or contractual technology transfer, these issues should be assessed separately.
