Patent applications for inventions in Kazakhstan are filed and prosecuted before the National Institute of Intellectual Property, commonly referred to as Kazpatent.

A patent application for an invention in Kazakhstan may be filed as a direct national application or as an international PCT application entering the national phase.
Convention priority may be claimed if the Kazakhstan application is filed within 12 months from the first filing date.
The application is filed with Kazpatent and typically includes the description of the invention, claims, abstract and drawings where applicable.
Kazpatent conducts formal examination shortly after filing to verify compliance with formal requirements.
If the application meets the formal criteria, it proceeds further in the examination process, subject to payment of the examination fee.
During substantive examination, Kazpatent evaluates whether the invention meets the patentability requirements.
The examiner may issue office actions requesting clarifications, amendments or additional arguments.
The application is published 18 months from the filing date.
After successful examination, Kazpatent issues a decision to grant the patent. The applicant pays the granting fee, the patent information is published in the official register, and the letters patent are issued.
Important: When paying the registration fee, maintenance fees for previous years starting from the filing date must also be paid.

Important: Notarisation is required if the power of attorney cannot be sealed by the applicant.
If the application is filed in English, a Russian or Kazakh translation may be requested by Kazpatent and must be submitted within two months.

A patent for an invention in Kazakhstan remains in force for 20 years from the filing date.
