Utility model applications in Kazakhstan are filed and prosecuted before the National Institute of Intellectual Property (Kazpatent).

How the Procedure Works

Stage 1: Filing the Application

The application is filed with Kazpatent and includes description, claims, drawings and abstract.

Convention priority may be claimed if the application is filed within 12 months from the first filing.

Stage 2: Formal Examination

Kazpatent conducts a formal examination to verify compliance with filing requirements.

The patentability of the utility model is not examined at this stage.

Stage 3: Publication

The application is published approximately 12 months from the filing date.

Stage 4: Grant of the Patent

After successful examination, Kazpatent issues a decision to grant the patent. The applicant pays the grant fee and the patent is registered and published.

Important: Maintenance fees for previous years must be paid at the time of registration.

Power of Attorney

The power of attorney must be signed and sealed by the applicant.

Important: Notarisation is required if the applicant does not use a company seal.

If the application is filed in English, a Russian or Kazakh translation may be required within two months.

Priority documents must also be submitted within two months from filing, where priority is claimed.

Term of Protection

A utility model patent in Kazakhstan is valid for 5 years from the filing date.

The term may be extended once for up to 3 additional years.

Maintenance fees are paid annually.

Important: A 3-year grace period is available for late payment of maintenance fees.
