Trademark Registration in Lithuania

Trademark protection in Lithuania may be obtained through national registration before VPB, EU trademark registration through EUIPO or international registration under the Madrid System.

Trademark registration in Lithuania is carried out through the State Patent Bureau of the Republic of Lithuania, Valstybinis patentų biuras (VPB).

Foreign applicants who do not reside in Lithuania must act through a registered Lithuanian patent attorney where required.

Filing Routes

National application: protection applies only in Lithuania.
EU trademark (EUTM): one registration through EUIPO provides protection across all EU Member States.
International registration: Madrid System route through WIPO may be used as part of a wider trademark strategy.

Procedure and Timing

The standard registration period is approximately 6–9 months if no opposition is filed.

Filing and Formal Examination

VPB checks completeness of the application and correctness of the classification of goods and services under the Nice Classification. This stage usually takes approximately 1–2 months.

Substantive Examination

In Lithuania, the Office examines absolute grounds for refusal, including distinctiveness and compliance with legal requirements.

Important: Relative grounds, such as conflicts with earlier third-party rights, are not examined by the Office and may become relevant through opposition after publication.

Publication and Opposition Period

After successful examination, the application is published in the official bulletin and a 3-month opposition period begins.

Registration

If no opposition is filed, the trademark is entered in the register and the certificate is issued.

Legalisation of the power of attorney is not required. Legal entities may need to provide an extract from the commercial register confirming the authority of the signatory.

Term, Renewal and Non-Use

The initial term of trademark protection in Lithuania is 10 years from the filing date.

Protection may be renewed indefinitely for further 10-year periods.

A registered trademark may be cancelled if it has not been used continuously in Lithuania for 5 years from the registration date.
