PCT National Phase in Belarus

Entry of an international PCT application into the national phase in Belarus through the National Center of Intellectual Property, with full representation of foreign applicants.

We support foreign companies and international applicants in entering PCT applications into the national phase in Belarus through the National Center of Intellectual Property (NCIP).

Foreign applicants act through a local patent attorney. We represent clients in Belarus and handle the full procedure without the need for their personal presence.

Deadline for Entry into the National Phase

A PCT application must enter the national phase in Belarus within 31 months from the priority date.

We monitor deadlines, notify clients in advance and ensure timely payment of official fees.

Required Documents

  • Power of attorney
  • Description, claims, drawings and abstract in Russian
  • Copy of the international application, where required

Important: The Russian translation must be submitted within 2 months from filing in Belarus. :contentReference[oaicite:0]{index=0}

The power of attorney does not require notarisation or legalisation and may be submitted within 2 months.

The date of signature of the power of attorney must precede the filing date.

How the Procedure Works

Stage 1: Entry into the National Phase

Filing of the application with NCIP and payment of the official filing fee. Amended claims may be submitted if required.

Stage 2: Substantive Examination

Examination begins upon filing a request. If an International Search Report is available, the official fee is reduced by 50%.

Important: Examination is not automatic and requires a separate request.

Stage 3: Grant of Patent

After a positive decision, issuance fees and accumulated annuities are paid, and the patent is granted.

Patent Term and Maintenance

The patent is valid for up to 20 years from the filing date, provided annual maintenance fees are paid.

We monitor annuity deadlines from the 3rd to the 20th year and notify clients in advance.

Cost Structure

The total cost typically includes:

  • official fees
  • patent attorney services
  • translation of the application
  • filing of requests and responses
  • receipt of the patent

The amount depends on the number of claims, availability of ISR and applicable official fees.
