A patent for invention in Russia grants exclusive rights to use the invention in Russia, subject to grant by Rospatent and timely payment of maintenance fees.
Applications for patents of invention are filed and prosecuted before the Federal Service for Intellectual Property, Rospatent.
Foreign applicants must act through a registered Russian patent attorney. We support international clients during filing, prosecution, grant and maintenance of Russian patents.
A patent for invention is valid for 20 years from the filing date, provided that maintenance fees are paid in due time.
A patent application in Russia may be filed as a direct national application or as an international application entering the Russian national phase under the PCT.
Convention priority may be claimed if the Russian application is filed within 12 months from the first filing.
A patent application typically includes the description of the invention, claims, abstract and drawings where applicable.
For filing, the applicant’s name and address, filing materials and a power of attorney are generally required.
The power of attorney must be signed by the applicant. Notarisation or legalisation is generally not required.
Important: If filing materials are submitted in English, a Russian translation may be requested by the patent office and must be submitted within the applicable deadline.
After filing, the Russian Patent Office conducts formal examination to verify compliance with formal requirements.
If the application meets the formal criteria, it proceeds further in the examination process. The application is usually published 18 months from the filing date.
Substantive examination is carried out upon request. The request must be filed within the prescribed term, generally within 3 years from the filing date.
During substantive examination, the office evaluates whether the claimed invention meets the patentability requirements.
The examiner may issue office actions requesting clarifications, amendments or arguments.
After successful examination, the patent office issues a decision to grant the patent.
The applicant pays the grant fee, the patent information is published in the official register and the letters patent are issued.
The grant fee also includes maintenance fees for the first five years of the patent term.
A Russian patent for invention remains in force for 20 years from the filing date.
Maintenance fees must be paid to keep the patent in force. Maintenance fees are currently paid in five-year blocks, with payments starting from the 6th year of the patent term.
A 6-month grace period is available for late payment, subject to payment of the applicable surcharge.
