Utility Models in Russia

A Russian utility model may provide protection for a technical solution where novelty and industrial applicability are relevant, without the inventive step requirement applied to inventions.

Utility model applications are filed with Rospatent and examined by FIPS. Foreign applicants who do not reside in Russia usually act through registered Russian patent attorneys.

The utility model route may be useful where a technical solution is new and industrially applicable, but a faster or more focused protection strategy is preferred.

Protection Requirements

A utility model must meet the requirements of novelty and industrial applicability.

Unlike an invention, a utility model is not examined for inventive step. This may make the route useful for certain technical solutions that do not justify or cannot support a full invention patent strategy.

Important: The scope and suitability of utility model protection should be assessed together with the claim structure, available prior art and commercial purpose of the filing.

Filing Routes

A utility model application in Russia may be filed as a national application, as a PCT national phase entry where applicable, or as a convention application claiming priority from an earlier filing.

  • direct national filing with Rospatent;
  • PCT national phase entry, usually within 30 months from the priority date;
  • convention filing with priority claimed within 12 months from the first filing.

Conversion into an Invention Application

At the application stage, a Russian utility model application may be converted into an invention application where the applicant decides to pursue protection as an invention.

This may be relevant where the technical solution can meet the higher patentability requirements applicable to inventions, including inventive step.

If the converted application proceeds to grant as an invention, the resulting patent is subject to the term applicable to patents for inventions — up to 20 years from the filing date, instead of the 10-year term applicable to utility models.

Important: This option is relevant before grant. After a utility model patent has been granted, longer protection generally requires a separate filing strategy rather than a simple conversion of the granted patent.

Examination Procedure

In a standard case, registration of a utility model in Russia may take approximately 6 to 12 months.

Formal Examination

The office checks whether the application complies with formal requirements, whether required documents are present and whether fees have been paid.

Substantive Examination

For utility models, substantive examination focuses on novelty and industrial applicability. Inventive step is not examined.

Publication and Grant

After a positive decision, information on the patent is published in the official bulletin and the patent is issued.

  • description of the utility model sufficient to disclose the technical solution;
  • claims defining the scope of protection;
  • abstract;
  • drawings, where necessary for understanding the solution;
  • proof of payment of official fees;
  • power of attorney for the patent attorney;
  • Russian translation where source materials are in another language.

Term and Maintenance

The term of a Russian utility model patent is 10 years from the filing date.

Maintenance fees are payable to keep the patent in force. Late payment may be possible within the applicable grace period, subject to an additional fee.
